Debt recovery, enforcement and insolvency help for international creditors and companies

Bayraktar Attorneys represents foreign individuals and businesses in bankruptcy, foreclosure and debt collection matters in Turkey. We act both for creditors chasing unpaid debts and for debtors facing enforcement, and we guide you through proceedings that can feel confusing when the language and procedure are unfamiliar.

Turkish enforcement and bankruptcy procedure is formal and time-sensitive. Deadlines are short, objections must be raised correctly, and one missed step can cost you the case. We handle the filings, the offices and the court appearances, and keep you informed at every stage in English.

How We Help Creditors and Debtors

Whether you are owed money or being pursued for it, the right early move matters. Our enforcement team acts on both sides and manages each case from the first notice through to recovery or resolution.

We support you across the full range of enforcement and insolvency work:

  • Starting and running debt collection through the enforcement offices
  • Enforcing cheques, promissory notes and court judgments
  • Seizing assets and selling them at auction to recover a debt
  • Foreclosing a mortgage or other security
  • Defending debtors and raising objections within the deadlines
  • Bankruptcy petitions, claims and restructuring (concordato)
  • Cross-border recovery and coordination with foreign proceedings

Debt Collection and Enforcement Proceedings

Turkish debt collection runs through the enforcement offices under a set procedure. The route depends on what your claim is based on, and picking the correct one at the start avoids delay and cost.

Enforcement without a judgment

For an ordinary unpaid debt you can start enforcement without first suing. A payment order is served, and if the debtor objects, the proceeding pauses until you remove the objection through the enforcement court. We handle both the filing and the follow-up.

Enforcement based on a judgment

If you already hold a court judgment or equivalent title, enforcement is stronger, because an ordinary objection does not simply stop it. We use this route to move quickly to seizure and sale.

Cheques, notes and bills

Cheques, promissory notes and bills of exchange qualify for a faster, specialised track. The debtor still has limited grounds to object, but the timetable is tighter. We enforce these instruments efficiently.

Seizure, Auction and Mortgage Foreclosure

When a debtor still does not pay, the enforcement office can move against the debtor assets. This is where a claim turns into real recovery.

The main steps and tools include:

  • Seizure (haciz) of bank accounts, wages, vehicles, real estate and other assets
  • Valuation and sale by public auction, with the proceeds paid toward the debt
  • Foreclosure of a mortgage (ipotek) to recover a secured debt from the property
  • Distribution among creditors where more than one has a claim
  • Tracing and challenging attempts to hide or transfer assets

Bankruptcy and Restructuring (Concordato)

Where a business cannot meet its debts, the picture moves from individual enforcement to collective procedures. Bankruptcy generally applies to merchants and companies, and it gathers the debtor assets for the benefit of all creditors together. As an alternative, court-supervised restructuring, known as concordato, lets a struggling but viable business propose terms to its creditors and, if approved, avoid liquidation. We advise creditors on how to protect and prove their claims, and we advise debtor companies on whether restructuring is a realistic route.

Objections, Deadlines and Defending a Debtor

If you are the one being pursued, you are not without options, but the deadlines are short and unforgiving. A payment order can often be challenged by filing an objection in time, and there are defences against wrongful, expired or already-paid claims. We assess whether the debt is valid, raise the correct objection at the enforcement office or court, and negotiate settlements or payment plans where that serves you better than a fight.

Cross-border and Foreign Clients

Foreign creditors and debtors often deal with assets, contracts or counterparties spread across more than one country. We recover debts in Turkey for clients abroad, advise on the recognition and enforcement of foreign judgments where that is possible, and coordinate with your lawyers in other jurisdictions. Much of this can be handled remotely under a power of attorney, and where the debt arises from a financing deal we work alongside our banking and finance team.

Our Process (Step by Step)

  1. Free Consultation and Case Review

We learn the facts, review the documents behind the debt, and set out your options, the likely route, and the timeline and cost.

  2. Strategy and the Right Track

We choose the correct enforcement or defence route, whether based on a judgment, an ordinary debt, a cheque or note, or a mortgage.

  3. Filing and Service

We start the proceeding at the enforcement office, serve the payment order, and manage any objection or response within the deadlines.

  4. Recovery or Resolution

We move to seizure, auction or foreclosure to recover the debt, or negotiate a settlement or payment plan where that is the better outcome.

  5. Distribution and Follow-up

We see the proceeds paid to you, handle any competing creditor claims, and advise on bankruptcy or restructuring if the debtor cannot pay.
