How We Protect Your Brand

A trademark is often one of the most valuable things a business owns, and in Turkey protection generally goes to the first party to register. Acting early, and correctly, is the surest way to secure your name, logo or slogan.

We manage the whole process for you, so nothing is missed:

  • Searching existing marks to gauge whether yours can be registered
  • Advising on the classes of goods and services you should cover
  • Preparing and filing the application through EPATS
  • Responding to deficiency notices and examination objections
  • Monitoring the publication period and handling oppositions
  • Obtaining the registration certificate once the mark is granted
  • Renewing, licensing and enforcing your trademark after registration

Who Can Apply for a Trademark

Under Article 3 of the Industrial Property Law, the following individuals and entities are eligible to apply for trademark registration with TURKPATENT:

  • Citizens of the Republic of Turkey
  • Natural or legal persons resident in Turkey, or engaged in commercial or industrial activities there
  • Applicants eligible under the Paris Convention or the World Trade Organization Agreement
  • Foreign nationals from countries that offer reciprocal trademark protection to Turkish citizens

Foreign applicants

If you are applying from abroad, you must be represented by a licensed Turkish trademark attorney. We act as your representative before TURKPATENT, file the application and manage every step, so your lack of a presence in Turkey is not an obstacle.

What a Trademark Application Needs

A complete trademark application in Turkey generally includes:

  • An application form with the applicant details
  • A clear representation of the trademark
  • A list of the goods or services to be covered
  • Proof of payment of the application fee
  • Technical specifications for collective or guarantee trademarks
  • Proof of payment of the priority claim fee, where a priority is claimed

The Registration Process

Applications are filed through EPATS, the electronic system of TURKPATENT, and a single application can cover multiple classes of goods or services. The main stages are:

Application and deficiency check

We file the application with the required documents. If any procedural issue is found, there is generally a two-month window to correct it, which we handle for you.

Examination

TURKPATENT examines the application. It can be refused on absolute grounds under Article 5 of the law, for example if the mark is not distinctive or is already taken. We advise on these risks before filing and respond to any objection.

Publication and opposition

If the application passes examination, the mark is published in the Bulletin for a two-month opposition period, during which third parties can object. We monitor this stage and defend your application against any opposition.

Registration and certificate

If no opposition succeeds and the registration certificate fee is paid, the trademark is registered. The certificate is generally issued within one month after payment.

Fees, Classes and Ongoing Protection

TURKPATENT updates its application and registration fees each year, so we confirm the current fee structure before you file. The cost also depends on how many classes of goods and services your application covers, and we help you choose the right ones so your protection is neither too narrow nor wider than you need.

A registered trademark is generally protected for ten years from the application date and can be renewed for further ten-year periods, so your brand can stay protected for as long as you use it. After registration we can also help you license the mark, and enforce it against copying, which fits naturally with protecting a brand you use in online sales.
