Family Residence Permit in Turkey: Rules and Renewal

The family residence permit is the permit held by the foreign spouse and children of a Turkish citizen, or of a foreign national who holds a valid residence permit in Türkiye. It is the most stable permit in the system and the one with the longest tail: after three years of marriage it opens the citizenship route, and it counts towards long term residence.

It is also the permit with the most conditions attached to somebody other than the applicant, because the requirements sit largely with the sponsor.

Who can hold it

  • The foreign spouse of a Turkish citizen or of an eligible sponsor. Where the sponsor has more than one spouse, only one may hold a family residence permit; children of the other spouses may still qualify.
  • Minor children of the sponsor or the spouse, including adopted children.
  • Dependent adult children.

Duration

The permit is issued for periods of up to three years at a time, and it may not extend beyond the duration of the sponsor's own permit. In practice first applications are frequently granted for a shorter period and lengthened on renewal, so a shorter first grant is not a sign of a problem.

Conditions on the sponsor

The sponsor must show, in outline:

  • Income of not less than the minimum wage in total, and not less than one third of the minimum wage per person in the household including the incoming family members.
  • Accommodation meeting general health and safety standards, and health insurance covering all family members.
  • No conviction for offences against family order in the preceding five years, established by criminal record check.
  • Registration in the address registration system.
  • Prior residence in Türkiye for at least one year, where the sponsor is a foreign national. This condition is not applied where the sponsor is a Turkish citizen.

Income is where most applications fail, and it fails on evidence rather than on amount. Declared and documented income is what counts, which regularly catches self employed sponsors and households whose actual income is well above the threshold but is not evidenced in a form the directorate accepts.

The marriage of convenience check

Applications based on marriage are assessed for genuineness, and the authorities may carry out enquiries, including at the home address, both on application and afterwards. A permit obtained through a marriage found to have been entered into for the purpose of obtaining it is cancelled, and the finding has consequences well beyond the permit: it affects any later citizenship application and can lead to removal.

Couples who genuinely live together sometimes struggle here, usually because of a mismatch between the address registration and the actual living arrangement. Getting the registration right before applying prevents most of these problems.

Children

Where a child is coming to Türkiye and custody is shared, the consent of the other custodial parent is required. A child holding a family residence permit must switch to another permit type on turning eighteen, and continuing to rely on the family permit after that point is a common cause of an unexpected refusal on renewal.

Divorce, and death of the sponsor

Divorce ends the basis of the permit, but not necessarily the right to remain. A foreign spouse who has held a family residence permit for at least three years may apply for a short term residence permit following divorce. Where the marriage ended because of domestic violence and this is established, the three year requirement is not applied. Where the sponsor dies, family members may apply for a short term permit without the three year condition.

These applications are time sensitive. The permit does not survive the event that ended the marriage, so the switch has to be made promptly rather than at the next renewal date.
