Eligibility for Trademark
Registration
According to Article 3 of the relevant Turkish law, the following individuals and entities may apply for trademark registration with the Turkish Patent and Trademark Office (TURKPATENT):
– Citizens of the Republic of Turkey.
– Natural or legal persons residing in or conducting industrial or commercial activities within Turkey.
– Persons eligible to apply under the Paris Convention or the Agreement Establishing the World Trade Organization.
– Individuals from countries that offer reciprocal protection of industrial property rights to Turkish citizens.
Applications can be submitted by the trademark owner or a trademark attorney. Applicants based outside of Turkey must be represented by a trademark attorney.
Requirements for Trademark Application
A complete trademark application must include:
– An application form with the applicant’s identification details.
– A representation of the trademark.
– A list of goods or services for which the trademark is being registered.
– Proof of payment for the application fee.
– For collective or guarantee trademarks, technical specifications.
– If claiming priority rights, proof of payment for the priority right claim fee.

Registration Process
Applications should be submitted via EPATS, TURKPATENT’s electronic system. A single application can include multiple classes of goods or services.
If there are any procedural deficiencies, applicants have two months to address them. Failure to do so results in the application’s cancellation. Applications may be rejected based on absolute grounds for refusal under Article 5 of the law. If there are no deficiencies or grounds for refusal, the application is published in the Bulletin for a two-month opposition period, during which relevant parties can file objections.
If no oppositions are filed and the registration certificate fee is paid, the trademark is registered and published in the Bulletin. The registration certificate is issued approximately one month after the certificate fee is paid.
Each year, the fees for application and registration are announced by TURKPATENT, and applicants should verify the current fee structure before proceeding.
